MANITOBA GAMES
VOLUNTEER AGREEMENT

THIS VOLUNTEER AGREEMENT CONFIRMS that the Parties have mutually agreed as follows:

Volunteer
1. The Parties agree and acknowledge that the relationship intended by this description of expectations is NOT an employment or independent contractor relationship and strictly a volunteer relationship.

Police Record Check
2. Upon the request from the 2026 Manitoba Games Host Society, the Volunteer agrees to obtain and submit a Criminal Records Check with Vulnerable Section Verification and Child Abuse Registry Check and will renew such security checks upon request of the 2026 Manitoba Games Host Society. The 2026 Manitoba Games Host Society, in its sole discretion, will determine whether such offences pose an unacceptable risk to the safety and security of the 2026 Manitoba Games Host Society, its members and participants and may terminate this Agreement immediately. Failure to comply with this section will result in ineligibility to volunteer with the 2026 Manitoba Games Host Society.

Responsibilities of the Volunteer

3. The Volunteer will:

1. Comply with the policies, procedures, rules and regulations of the 2026 Manitoba Games Host Society.
2. Devote their full time and attention during volunteer hours to the business and interests of the 2026 Manitoba Games Host Society as directed.
3. Comply with the following expected standard of ethical conduct at all times, while volunteering with the Organization:
   1. Demonstrate through words and actions the spirit of sportsmanship, sports leadership and ethical conduct;
   2. Treat others with respect and refrain from negative or disparaging remarks or conduct;
   3. Avoid and reject the non-medical use of drugs or methods;
   4. Refrain from consuming alcohol and tobacco products;
   5. Refrain from any behaviour that constitutes harassment or sexual harassment;
   6. Refrain from the use of power or authority in an attempt to coerce another person to engage in inappropriate activities; and
   7. Adhere to all Federal, Provincial, or Municipal laws.

Expenses
4. The Volunteer will be solely reasonable for all out-of-pocket expenses properly incurred in the course of volunteering.

Medical Consent

5. The Volunteer, and their parent(s)/legal guardian(s) in the case of a minor:

1. Give permission to the licensed physician, dentist, athletic therapist, nurse or other medical professional, whose services might be required, to provide medical care and treatment.
2. Understand and have the capacity to communicate health care directives for myself or my child/ward and that I am fully informed as to the contents of this document and understand the full import of this grant of powers.

Image Consent and Release
6. The Volunteer hereby grants to Sport Manitoba and the 2026 Manitoba Games Host Society its agents on a worldwide basis, the permission to take, use and copyright in their own name photographs, videotapes, digital and video images, films, voice recordings or any other likeness of me/my child/ward (collectively the “Images”), to use, transmit, publish and sell such Images, in any format, style, form or media. This consent will remain in effect in perpetuity.

7. The Volunteer further agree that all Images, plates, negatives and masters relating to the foregoing will be owned by Sport Manitoba and the 2026 Manitoba Games Host Society.

8. The Volunteer hereby fully release, discharge, and agree to save harmless Sport Manitoba and the 2026 Manitoba Games Host Society, for any and all claims, demands, actions, damages, losses or costs that might arise out of the collection, use or disclosure of the Images or taking, publication, sale, distortion of the Images, plates, negatives, and masters or any other likeness or representation of me/my child/ward that may occur or be produced in the taking of said Images or in any subsequent processing thereof, including without limitation any claims for libel, passing off, misappropriate of personality or invasion of privacy.

Personal Information

9. The Volunteer authorizes Sport Manitoba and the 2026 Manitoba Games Host Society to collect and use personal information about me/my child/ward for the purposes described in the Sport Manitoba’s Privacy Policy and to:

1. Receive communications relating to the Manitoba Games
2. Receive communications about current and future Sport Manitoba programs and the Power of Games eNews
3. Contact the Volunteer to conduct research in an effort to continually improve Sport Manitoba programs
4. Disclose to other Provincial Sport Organizations when necessary – to confirm rosters, clinic notifications, etc.

10. The Volunteer may withdraw their consent provided in Section 9 by providing such notice by email to info@sportmanitoba.ca. Sport Manitoba will advise the Volunteer the implications of such withdrawal.

Confidential Information

11. The Volunteer agrees:

1. Agrees not to publish, communicate, divulge or disclose to any unauthorized third party any Confidential Information, without the prior written consent of Sport Manitoba and the 2026 Manitoba Games Host Society.
2. Not to allow other persons or third parties access to the Confidential Information.
3. To comply with the requirements of the Personal Information Protection and Electronic Documents Act.
4. To use Confidential Information solely as may be required in connection with the Volunteer’s responsibilities to Sport Manitoba and the 2026 Manitoba Games Host Society.

12. Confidential Information includes, but is not limited to, personal information, business information relating to Sport Manitoba’s and the 2026 Manitoba Host Society’s plans, services, finances, athletes, participants, members, marketing, future business and sponsorship plans and any other information which is identified as confidential by Sport Manitoba and the 2026 Manitoba Games Host Society.

Intellectual Property
13. Copyright and any other intellectual property rights in all written material (including material in electronic format), databases, personal information, Confidential Information and other works produced by the Volunteer will be owned solely by Sport Manitoba, who will have the right to use, reproduce or distribute such material and works, or any part thereof, for any purpose it wishes. Upon the request of Sport Manitoba or termination of this Agreement, the Volunteer will return all Confidential Information and propriety information received in written or tangible form, including copies, or reproductions or other media, immediately of such request.

Term and Termination
14. This Agreement will start on the 1st day of April, 2025 and will terminate on the 7th day of March, 2026, unless terminated earlier in accordance with this Agreement. There will be no automatic renewal of this Agreement. Volunteers wishing to continue volunteering must re-apply.

15. Either Party may terminate this Agreement immediately upon providing the other Party with written notice of their intention to terminate this Agreement, which will terminate accordingly.

16. The provisions of this Agreement will survive indefinitely on a world-wide basis.

Indemnity

17. The Volunteer will indemnify and hold harmless Sport Manitoba, 2026 Manitoba Games Host Society and its directors, officers, consultants, agents and employees (collectively the “Indemnified Parties”) from and against any and all loss of, or damage to, property, or injuries to, or death of, any person or persons (collectively the “Losses”) and will defend, indemnify and hold harmless the Indemnified Parties, or any of them, from any and all claims, damages, suits, costs, expenses, liabilities, fines, obligations, penalties, demands, actions or proceedings of any nature or kind whatsoever (including, without limitation, reasonable legal fees and disbursements) of or by anyone whosoever (collectively the “Damages”), resulting from, or arising out of, directly or indirectly:

1. Any negligent act or omission or willful misconduct of the Volunteer
2. Any breach of PIPEDA, Anti-Spam Laws, term, obligation, requirement, covenant or condition of this Agreement

Assignment
18. The Volunteer will not assign, either directly or indirectly, any obligation or entitlement that it has under this Agreement without express written consent of Sport Manitoba.

General
19. The Volunteer and the Volunteer’s parent/guardian, if the Volunteer is under the age of majority, herby agrees to abide by the terms and conditions outlined in this Agreement. To evidence their agreement, and the Volunteer’s parent/guardian, if the Volunteer is under the age of majority, have signed this Agreement.

MANITOBA GAMES
INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT

1. This is a binding legal agreement; therefore clarify any questions or concerns before signing. As a Volunteer in the activities, programs and events of the Manitoba Games (collectively the “Activities”), the undersigned, being the Volunteer and the Parent/Guardian of the Volunteer (collectively the “Parties”), acknowledge and agrees to the following terms.

Disclaimer
2. Sport Manitoba, the 2026 Manitoba Games Host Society and its directors, officers, members, employees, coaches, volunteers, officials, participants, agents, sponsors, organizers, and representatives (collectively the “Organization”) are not responsible for any injury, property damage, expense, loss of income, damage or loss of any kind suffered by a Volunteer during, or as a result of, the Activities.

Description of Risks

3. The Volunteer is participating voluntarily in the Activities. In consideration of that participation in the Activities, the Parties hereby acknowledge that they are aware of the risks, dangers and hazards associated with or related to the Activities and may be exposed to such risks, dangers and hazards which can be severe and even fatal. The risks, dangers and hazards include, but are not limited to, injuries from:

1. The risks, dangers and hazards particular to the Activities in which I am participating;
2. Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements;
3. Failing to play safely or within one’s ability or to remain with designated areas;
4. Physical contact with other people;
5. Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;
6. Failing to comply with the rules established for volunteering;
7. Falling, tumbling or hitting other surfaces;
8. Falling to the ground due to uneven, slippery or irregular surfaces;
9. Contacting, colliding or being struck by other individuals, equipment, stands, or benches;
10. Extreme conditions which may result in heatstroke, hypothermia, heart attack, stroke, dehydration or any other condition that results from being exhausted; or
11. Travel to and from Activities which are an integral part of the Association’s activities

4. In consideration of the Organizations allowing the Volunteer to participate in Activities, the Parties agree:

1. That the Volunteer’s physical condition has been verified to volunteer in the Activities by a medical doctor and no medical condition will be worsened by the Volunteer’s participation in the Activities;
2. That the Volunteer has been adequately trained for the Activities;
3. To freely accept and fully assume all such risks, dangers and hazards and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from the Volunteer’s participation in the Activities.

Acknowledgement
5. The Parties acknowledge that they have read this agreement and understand it, that they have executed this agreement voluntarily, and that this agreement is to be binding upon themselves, their heirs, executors, administrators and representatives.
